Terms of Service By signing up and actively using the penniesbyemail.com program you agree to all terms and conditions set forth in this agreement. penniesbyemail.com may, at any time, choose to edit, add and/or delete portions of this agreement and impose changes without prior notification of its members.(But we always do) Members will be informed of any and all changes to this policy via an email to their primary contact email address provided upon signing up with penniesbyemail.com. If any modification is unacceptable to you, your only recourse is to terminate this agreement. Your continued participation in the penniesbyemail.com program following our posting of a change in policy notice or new agreement on our site will constitute binding acceptance to the change. Responsibility of Members: You agree to "actually *gasp* read emails. You must be 18 years of age or older to participate in this program. Our program is void where prohibited by local governing laws. You agree to and must use your own name and email address in the sign-up process and may not assume a false identity. You may not signup multiple times with different email addresses. Your computer must not be shared with another individual that has an existing penniesbyemail.com account.ONE account per household (There are NO exceptions) You will use your user name / password combination to access your account, it is your responsibility to keep this information confidential, you may change this information by logging into your penniesbyemail.com account and pressing the change information link. Any solicitation of advertisers for a confirmation email for purposes of receiving credit in your account will be grounds for immediate termination. You are solely responsible for any and all use of your penniesbyemail.com account including authorization by you to any third party individual who may use your account. Should any instances of fraud, system abuse, or any type of activity deemed to be inappropriate or illegal by penniesbyemail.com be detected it may result in member termination and possible legal action. You must maintain an email account and keep that info current. You agree to receive email advertising from penniesbyemail.com. In the event your email account on file becomes closed or blocked for 30 (thirty) or more days to messages from penniesbyemail.com your account will be terminated and you will forfeit all prior earnings.No activity at all, for non gold members, for 60 days will result in you going bye bye as well. If it has been 6 months since we have heard from you, no matter if you are a gold member, we assume you have died, send condolences to your loved ones,and your account is cremated and the ashes scattered. You also need to click at least one link within 30 days of sign up, you need to be 10% as active as your referrals to earn from them (did we get all that? an interpretor may be nice here...) Relationship of the Parties: You and penniesbyemail.com are independent contractors, and nothing in this Agreement creates any partnership, joint venture, agency, franchise, sales representative or employment relationship between you and penniesbyemail.com. You understand that you do not have authority to make or accept any offers or make any representations on behalf of penniesbyemail.com. You may not make any statement, whether on your site or otherwise, that would contradict anything in this section. (you are you, we are us, let's keep it that way, hmmm?)You are solely responsible for the reporting and payment of any taxes for money earned while using the penniesbyemail.com program. (wow, still with us?) Limitation of Liability: penniesbyemail.com will not be liable for lost profits, lost business opportunities, or any other indirect, special, punitive, incidental or consequential damages arising out of or related to this Agreement or penniesbyemail.com program, even if penniesbyemail.com has been advised of the possibility of such damages. Furthermore, penniesbyemail.com aggregate liability arising under this Agreement will not exceed the amount of the total fees paid or payable to you under this Agreement. The provisions of this Section survive termination or expiration of the Agreement. (aggregate? What the... anyone have a lawyer handy?) Payments: Members may earn by receiving paid-emails, opening them, reading them, then visiting the advertiser link after they have... "read the email". Members may earn by clicking the offers in the paid to click area Members may earn by referring new members to the penniesbyemail.com program. Members will earn 15% of their direct referrals earnings and 10% of their indirect referrals earnings level 2, 8% level 3, 7 percent level 4, 5 percent level 5. Members may not earn by selling their mother-in-laws or first born children. Members who use any kind of software to avoid "reading the emails" will be deleted. They will be blocked from the site. They will be sent MY first born child and mother in law. Members will be paid via PayPal, or E-gold (Members who can only get paid by e-gold will need to be paid via paypal for first cashout,Or send us a scanned identification card. gold members are exempt from this, write us for different ways of avoiding this). Ocassionally when we have other types of funds, we will let members know that is available. penniesbyemail.com will pay members when they request payment. There is a $5 minimum amount to request payment. Members will be paid within 30 - 90 days of the date payment was requested or a reasonable time after. (Ah that was the good part ;) Spam: You may not promote your referral links through unsolicited emailing (i.e. SPAMMING)(SPAM, BAD, SPAM POETS, GOOD), newsgroup postings, or any other method of mass communication. Failure to comply will result in immediate termination of your membership with penniesbyemail.com and may result in legal prosecution. penniesbyemail.com strictly enforces anti-spamming laws. Spamming is a federal crime. (But your honor, I SWEAR I do so know everyone in the aol, hotmail and yahoo memberbase) Any member caught spamming will not only have their account terminated immediately and lose any past, present and future earnings, as well as be required to provide lifetime support of afore said mother-in-law, but shall also be held liable for Spamming as we shall cooperate with any authorities and investigations that may arise from the Spamming incident. penniesbyemail.com may charge up to $5 per spam email sent. Multiple signups shall be grounds for immediate termination of all involved accounts. Signing up multiple times from the same computer also constitutes fraud. penniesbyemail.com will file charges for recovery of any earnings received from multiple signups. CONGRATS! ya made it!
